The JamCore Training™ team welcomes you to its site at www.myfittribe.com ("Site"). To reach your fitness goals, we hope that JamCore Training can help you see it and achieve it, and that we can make it fun and effective for you. The following basic terms govern your use of the Site. Your use of the Site constitutes your agreement to follow and be bound by these terms (the "Agreement").

EFFECTIVE DATE

This Agreement and Privacy Policy is effective upon your first visit to the Site.

PRIVACY
We encourage you to review our Privacy Policy, which is hereby incorporated into these Terms of Use.

CHANGES TO THIS AGREEMENT
We may from time to time change the terms of this Agreement and Privacy Policy. If you are an unregistered user or visitor to our Site, your use of our Site following any such change will constitute your agreement to follow and be bound by the terms as changed. If you are a registered user of our Site, you will receive an e-mail notice at the time such changes are implemented.

SITE CONTENTS
We reserve the right to make changes and amendments to the Site and its content as necessary. Unless otherwise noted, all materials, including images, illustrations, designs, icons, photographs, video clips, and written and other materials that appear as part of this Site, including the source HTML and any other machine code used to operate the site, (collectively, the "Contents") are copyrights, trademarks, trade dress and/or other intellectual properties owned, controlled or licensed by JamCore Training, Inc. (“JamCore”). This includes in particular, but is not limited to the JamCore™ name by itself or in combination with any other words in any format, as well as the JamCore Training logo, the JamCore medicine ball icon, the “See It. Achieve It.™” tagline are all trademarks of JamCore.

You may download or copy the Contents and other downloadable materials displayed on the Site only for your personal use. No right, title or interest in any downloaded materials or software is transferred to you or any third party as a result of any such downloading or copying. Except as stated above, you may not publish, distribute, display, modify, create derivative works from, participate in any sale of, or exploit to the detriment of JamCore in any way, any of the Contents, the Site, or any related software.

USER COMMENTS AND OTHER SUBMISSIONS
All comments and other submissions, such as user feedback, (“Comments”) disclosed by you to JamCore through use of this Site shall be JamCore property. JamCore shall not be limited in any way in its use, commercial or otherwise, of any Comments. JamCore is not obligated to pay to user any compensation for any Comments or to respond to any user Comments. As set forth in our Privacy Policy, JamCore will hold private the Collected Information; however JamCore is not obligated to hold private any Comments and may use Comments for marketing or other public purposes after having made a reasonable attempt to reach you to advise you of such intended use. You agree that JamCore may use and/or disclose information about demographics and use of the Site in any manner that does not reveal your identity.

You agree that no Comments submitted by you to the Site will violate any right of any third party, including copyright, trademark, privacy or other personal or proprietary right(s). You further agree that no Comments submitted by you to the Site will be or contain libelous or otherwise unlawful, abusive or obscene material. You are and shall remain solely responsible for the content of any Comments you make.

This Site may contain links to outside websites, services and resources, the avialability and content of which JamCore does not control. Any concerns regarding any such website, service or resource, or any link thereto, should be directed to the particular outside website, service or resource.

BEFORE MAKING ANY SIGNIFICANT DIET AND EXERCISE CHANGES, JAMCORE RECOMMENDS THAT YOU CONSULT WITH YOUR PHYSICIAN, AND THAT YOU CONTINUE TO DO SO DURING ANY SUSTAINED PERIOD OF WEIGHT LOSS. ALL INFORMATION ON THIS SITE IS OF A GENERAL NATURE AND IS NOT TO BE TAKEN AS MEDICAL OR HEALTH ADVICE PERTAINING TO YOUR SPECIFIC HEALTH AND MEDICAL CONDITION. From time to time there may be information at the Site that contains typographical errors, inaccuracies, or omissions. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice. We strive to deliver accurate and valuable data and services and apologize for any inconvenience that errors, inaccuracies, or omissions may cause, but JamCore may not be held liable for any personal decisions you may make based on inaccuracies.

CHILDREN’S PRIVACY
We do not structure our website to attract children. Accordingly, we do not to intend to collect personal information from anyone whom we know to be under 13 years of age. If you are under the age of 13, please do not supply any personally identifiable information through the site. If you are under the age of 13 and have already provided personally identifiable information through the site, please have your parent or guardian contact us immediately at safekids@jamcoretraining.com so that we can remove such information from our files.

INDEMNIFICATION
You agree to defend, indemnify and hold JamCore harmless from and against any and all claims, damages, costs and expenses, including attorneys' fees, arising from or related to your use of the Site.

SEVERABILITY
In the event that any provision of this Agreement shall be unenforceable or invalid under any applicable law or be so held by applicable court decision, such unenforceability or invalidity shall not render this Agreement unenforceable or invalid as a whole, and, in such event, such provisions shall be changed and interpreted so as to best accomplish the objectives of such unenforceable or invalid provision within the limits of applicable law or applicable court decisions.

MISCELLANEOUS
This Site is controlled and operated by JamCore from its offices in California. This Agreement shall be construed in accordance with the laws of the State of California, without regard to any conflict of law provisions. Any dispute arising under this Agreement shall be resolved exclusively by the state and federal courts of the State of California and the relevant jurisdictions of our corporate offices.

MEMBERSHIP
Additional terms of use apply for membership in JamCore Training and augment these terms of use. The effective date for the additional terms of use for membership begins upon any access to the members area, you agree to

1. Do your best to increase your level of fitness and wellness, and to have fun doing so;
2. Pay your membership fee and any amounts owed JamCore Training based upon your membership sign-up and usage of the members area of the site;
3. Consult with your medical professional on diet and exercise changes, and at the first sign of any unusual pain, soreness, swelling or other sign of injury;
4. Act responsibly in any and all communications with members of the JamCore training team, staff, management and JAM Community, and never engage in communications that could be deemed abusive, spam or otherwise in violation of reasonable rules of conduct.

TERMINATION AND SURVIVAL
This Agreement is effective unless and until terminated by either you or JamCore. You may terminate this Agreement at any time upon providing written notice to JamCore at which time JamCore may deny you access to the Site. JamCore also may terminate this Agreement at any time and may do so immediately without notice, and accordingly deny you access to the Site, if in JamCore's sole discretion you fail to comply with any term or provision of this Agreement. Upon any termination of this Agreement by either you or JamCore, you must promptly destroy all materials downloaded or otherwise obtained from this Site, as well as all copies of such materials, whether made under the terms of this Agreement or otherwise. JamCore’s ownership rights and the indemnifications set forth in these Terms of Service shall survive termination of the Agreement.
